Terms of Service

Please read these Terms of Service carefully before using WebShiftPlanner. By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of WebShiftPlanner ("Service"), operated by WebShiftPlanner Ltd., a company registered in Cyprus ("we", "us", or "our"). These Terms constitute a legally binding agreement between you and WebShiftPlanner Ltd.

By creating an account, accessing the Service, or clicking "I agree", you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We may update these Terms from time to time. We will notify registered Manager accounts by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.

Description of Service

WebShiftPlanner is a cloud-based staff scheduling platform designed for small and medium-sized businesses in the hospitality, retail, healthcare, and service industries. The Service enables:

  • Creating, editing, and publishing weekly and monthly employee schedules
  • Managing shift assignments, swap requests, and approvals
  • Sending automated email notifications when schedules are published and reminders 24 hours before shifts
  • Tracking actual and equivalent working hours, including holiday rate multipliers
  • Exporting schedule and payroll reports in PDF format
  • Employee self-service portal for viewing shifts and submitting swap requests

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

User Accounts and Responsibilities

Account types. The Service has two account types: Manager accounts (business owners or administrators) and Employee accounts. Manager accounts are created via the registration page. Employee accounts are created by Managers.

Accurate information. You must provide accurate, current, and complete information during registration and keep it up to date. Providing false information may result in account termination.

Account security. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@webshiftplanner.com if you suspect unauthorised access to your account.

Non-transferability. Your account is personal and may not be transferred to or shared with any other individual or entity.

Acceptable use. You must not:

  • Use the Service for any unlawful purpose or in violation of applicable regulations
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Upload, transmit, or distribute malicious code, viruses, or harmful data
  • Scrape, crawl, or systematically extract data from the Service
  • Use the Service to send unsolicited communications (spam)
  • Reverse-engineer, decompile, or disassemble any part of the Service

Age requirement. You must be at least 18 years old to create a Manager account.

Payment and Subscription Terms

Plans. The Service is offered on a monthly subscription basis. Current pricing:

  • Starter — €9/month (up to 10 employees)
  • Growth — €19/month (up to 25 employees)
  • Pro — €39/month (unlimited employees)

All plans include the same full set of features. The only difference between plans is the maximum number of employee accounts you may create.

Billing. Subscriptions are billed monthly in advance. To start, upgrade, or change your plan, contact us at support@webshiftplanner.com. Plan changes are processed within 24 hours on business days.

Employee limits. If you reach the employee limit of your current plan, you must upgrade to add additional employees. Existing employee accounts are not affected by the limit.

Failed payments. If a payment fails, we will notify you by email. Access to Manager features may be suspended after 7 days if payment is not received. Employee accounts can still view previously published schedules during the suspension period.

Price changes. We will provide at least 30 days' written notice before any price changes take effect.

Cancellation Policy

How to cancel. You may cancel your subscription at any time by emailing support@webshiftplanner.com with the subject line "Cancellation Request". Include your registered email address and business name.

Effect of cancellation. Upon cancellation, your access to Manager features continues until the end of the current billing period. After this period your account is deactivated and employee accounts are suspended.

Data retention. Following deactivation, your data is retained for 30 days, during which you may request a full data export by emailing support@webshiftplanner.com. After 30 days, all your business data, employee records, and schedules are permanently deleted from our systems.

No refunds. We do not offer refunds for partial months or for any unused portion of a subscription period.

Limitation of Liability

No warranties. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Service availability. We strive to maintain high availability but do not guarantee uninterrupted, error-free access. Scheduled maintenance will be communicated in advance where reasonably practicable.

Liability cap. To the fullest extent permitted by applicable law, WebShiftPlanner Ltd.'s total cumulative liability to you for any claims arising under or in connection with these Terms shall not exceed the total subscription fees paid by you in the three (3) months immediately preceding the claim.

Exclusion of consequential damages. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or loss of goodwill, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits our liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded under applicable EU or Cypriot law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions.

Any dispute arising from or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus, except where mandatory provisions of your local law apply.

If you are a consumer based in the European Union, you retain the benefit of any mandatory consumer protection provisions afforded by the laws of your country of residence, and you may also be entitled to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
